1. Acceptance and Definitions
These Terms of Service (“Terms”) govern your use of Story Writing Lab, operated by Wise Owl Solutions LLC (“Story Writing Lab,” “we,” “us”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, do not use the Services.
- Services: the Story Writing Lab website, web app, games, AI features, and related support.
- Teacher: a teacher, administrator, or other school staff member who creates an account.
- Student: a person who joins a Teacher's game with a game code. Students do not have accounts.
- School: the school, district, or other educational organization a Teacher works for or on behalf of.
- Content: anything submitted to the Services, including stories, prompts, rubrics, uploaded files, and comments.
2. The Services
Story Writing Lab is a browser-based writing game for classrooms. Teachers create games, and Students write stories in timed rounds, vote on each other's work, and receive rubric-based feedback that is drafted with AI and reviewed by their Teacher.
3. Eligibility and Accounts
- Only adults (18 or older) acting as teachers or school staff may create an account. Students take part only through a Teacher's game and do not create accounts.
- If you use the Services with Students, you confirm that you have the authority from your School to do so, including any consent required under the Children's Online Privacy Protection Act (COPPA) and the Family Educational Rights and Privacy Act (FERPA), and that you will supervise Students' use of the Services.
- You agree to provide accurate account information, keep your login credentials confidential, and tell us right away about any unauthorized use of your account. You are responsible for activity under your account. Accounts are individual and may not be shared or transferred.
- You can ask us to delete your account at any time by emailing support@storywritinglab.com, as described in the Privacy Policy.
4. Teacher Responsibilities
- Have Students join with a first name or nickname, not a full name.
- Do not enter sensitive Student information (such as health, disciplinary, or special education details) in prompts, rubrics, or comments.
- Follow your School's policies on classroom technology.
- Keep game codes within your class so only your Students can join.
5. Plans, Trials, and Billing
- Teachers can use Story Writing Lab for free. Some features, such as AI feedback beyond plan limits, require a paid plan. Plan features and limits are described in the Services and on our pricing page.
- We may offer a free trial of paid features (currently 14 days). Trials may include usage limits and end automatically unless you choose a paid plan.
- Individual paid plans are billed in advance through our payment processor, Stripe, and renew automatically until canceled. School and district plans follow the terms of the quote, order form, or invoice.
- You can cancel at any time. After you cancel, you keep access to paid features until the end of the current billing period.
- Payments are non-refundable. We do not provide refunds or credits for partial billing periods or unused features, except where required by law.
- We may change prices with advance notice. Price changes take effect at your next billing period.
6. Communications
By creating an account, you agree to receive service emails about your account, billing, and security, as well as product updates and our newsletter. You can unsubscribe from product updates and the newsletter at any time using the link in the email or by contacting support@storywritinglab.com. Service emails will continue while your account is active.
7. Acceptable Use
You agree not to:
- Use the Services for anything illegal or harmful.
- Submit Content that is obscene, hateful, harassing, bullying, or that infringes someone else's rights.
- Try to access another Teacher's account, class, or games, or join games you were not invited to.
- Disrupt the Services, probe for vulnerabilities without following Section 14, or reverse engineer the Services.
- Scrape, copy, or collect data or personal information from the Services without permission.
- Impersonate another person or organization.
We may remove Content or suspend access that violates these Terms.
8. Content and Intellectual Property
- You own your Content. Teachers and Students keep ownership of the Content they create.
- You give us a limited, non-exclusive, royalty-free license to host, store, process, display, and share your Content within the Services only as needed to operate, provide, and improve the Services for you and your School. This license ends when the Content is deleted, except for copies in backups that are removed as those backups expire.
- We do not use your Content or Students' Content to train AI models, and we do not use Student Content for marketing.
- You confirm that you have the rights to the Content you upload, such as rubrics and images.
- The Services, including our software, design, game materials, and brand, belong to Story Writing Lab and are protected by law. Report copyright concerns to support@storywritinglab.com.
9. AI-Generated Content
Some features use AI to generate feedback, scores, rubrics, writing challenges, and images. AI output can be inaccurate, incomplete, or inappropriate for a particular student, and it does not replace a teacher's professional judgment. Teachers are responsible for reviewing AI feedback and scores before sharing them with Students or using them for grading.
10. Privacy
Our Privacy Policy explains how we collect, use, and protect information, including the list of service providers we use.
11. Termination
You may stop using the Services and ask us to delete your account at any time. We may suspend or end your access if you violate these Terms or if your use harms other users or the Services. When an account is closed, we delete its information as described in the Privacy Policy. Sections that by their nature should survive termination (such as Sections 8, 12, 13, and 16) will survive.
12. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the extent allowed by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that AI output will be accurate.
13. Limitation of Liability
To the extent allowed by law, Story Writing Lab will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits. Our total liability for any claim related to the Services is limited to the amount you paid us in the 12 months before the claim.
14. Responsible Disclosure
If you find a security vulnerability, please report it to support@storywritinglab.com with enough detail for us to reproduce it, and give us a reasonable time to fix it before sharing it publicly.
15. Indemnification
You agree to defend and hold Story Writing Lab harmless from claims arising out of your Content or your violation of these Terms, to the extent allowed by law. This section does not apply to public schools or government entities that are prohibited by law from providing indemnification.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Lubbock County, Texas, unless the law that applies to your School requires otherwise.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify Teachers by email or in the Services before the changes take effect. Continuing to use the Services after the changes take effect means you accept the updated Terms.
18. Interpretation
Words in the singular include the plural and vice versa, and references to any gender include all genders. Headings are for convenience only.
